Experience Booking Terms and Conditions

We offer experience packages, guides and special promotions celebrating the British countryside, which we can arrange for you on your behalf through our network of third party suppliers ("Epicurean Experience Packages"). A list of the Epicurean Experience Packages is available by calling our Epicurean Experience booking line on +44 (0)203 868 4999 or on our website at www.epicurean.club/experiences. The Epicurean Experience Packages do change from time to time but you can always find out the current list of the services and accommodation on offer by calling us on the above number or by looking on our website.

1. These terms

1.1 What these terms cover. These terms and conditions ("Terms") are the terms and conditions on which you agree to order and we agree to supply to you Epicurean Experience Packages from time to time and are also found on our Epicurean Experience website at www.epicurean.club/experiences.

1.2 Parties to these terms. These Terms apply between:

(a) Epicurean Club Limited (Company No. 09764412) whose registered office is at 120 Old Broad Street, London, England, EC2N 1AR ("Epicurean", "we", "our" or "us"); and

(b) you, the customer ("you" or "your"). If you are booking on behalf of a group, "you" and "your" shall be deemed to include each member of that group.

1.3 Please read these terms carefully. These Terms tell you who we are, how we will provide Epicurean Experience Packages to you, how you and we may end the contract, what to do if there is a problem and other important information. Please read these Terms carefully and make sure you understand them before you submit an Epicurean Experience Package order through us. By submitting an order for an Epicurean Experience Package, you agree to be legally bound by these Terms.

1.4 How these terms will apply. Every time you purchase any Epicurean Experience Package, the Terms in force at that time will be incorporated into the contract between us and will apply between you and us and by ordering any Epicurean Experience Package you agree to be bound by these Terms. We may revise these terms and conditions from time to time. Please ensure that you read these Terms (along with any other terms referred to in clause 7.5) before placing an order for any Epicurean Experience Package and make sure that you understand the Terms that will apply to your order.

2. Information about us and how to contact us

2.1 Who we are. We are Epicurean Club Limited (Company No. 09764412) whose registered office is at 120 Old Broad Street, London, England, EC2N 1AR.

2.2 How to contact us. You can contact the Epicurean Experience team by telephoning us on +44 (0)203 868 4999 or by emailing us at enquiries@epicurean.club.

2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address/postal address you provided to us when you first placed an order for an Epicurean Experience Package or as you otherwise notify to us from time to time.

3. Epicurean Experience Packages

3.1 Making an order. Once you have decided which Epicurean Experience Package you wish to order, you can order a Epicurean Experience Package by contacting our Epicurean Experience team on +44 (0)203 868 4999. When you contact us via telephone, you will be required to provide personal information, including your name, email address, postal address and payment details. Further details of how we use your details are set out in clause 7 below.

3.2 Acknowledgement of your order. When placing an order for an Epicurean Experience Package, we may send you an email acknowledgement of your order, but this email does not necessarily confirm our acceptance of your order and we are entitled to refuse any order placed by you at any time up to acceptance of that order.

3.3 Confirmation of your order. Acceptance of any order only occurs at the time we receive the funds for the Epicurean Experience Package which you have ordered (see clause 4 for further details). Once we have received your payment, we will send you an email confirmation stating that your order has been accepted. The contract between us will only be formed when we send you this confirmation.

3.4 If we cannot process your order. During the time delay between you placing, and us accepting, your order it is possible that the third party supplier's services may become unavailable. We will advise you if this occurs and you will not be charged by us for the Epicurean Experience Package you requested. If you have any have any questions about your order please contact us in accordance with clause 2.2 above.

3.5 Our responsibilities. We are responsible for arranging and concluding your order. We will collect and receive your payment for the Epicurean Experience Packages on behalf of the relevant third party supplier in accordance with clause 4 and this will discharge your debt to that third party supplier for the services you receive.

3.6 Minimum age requirements. Certain Epicurean Experience Packages are only for customers satisfying a specified minimum age requirements. Where this is the case, we will inform you of such minimum age requirements at the time of placing your order. We will be unable to accept your order if you do not meet any specified minimum age requirement. Please do not attempt to order any Epicurean Experience Packages on behalf of anyone who does not meet any specified minimum age requirement, as this may result in that person being unable to enjoy the Epicurean Experience Package and a refund will not be provided in such circumstances.

3.7 Additional information may be required. In order for certain Epicurean Experience Packages to be provided to you, we may need to provide the third party supplier with additional information in relation to the particular services to enable them to complete your order. If such additional information is required, we will contact you about this using the email address or telephone number provided when you contacted our Epicurean Experience team. If you do not, after being asked by us, provide us with this information, or you provide us with incomplete or incorrect information, we may not be able to provide the Epicurean Experience Packages to you. In the event we are unable to place an order for you, we will inform you that we have been unable to complete your order in writing and for the avoidance of doubt, you will not have to pay for any Epicurean Experience Packages which have been requested. We will not be liable for any delay or non-performance in placing an order.


4.1 The Package Travel, Package Holidays and Package Tours Regulation require us to provide security for the monies which you pay for the Epicurean Experience Package. We have insurance in place under which our insurer agrees to cover the cost of your Epicurean Experience Package in the event that we go insolvent before we have provided you with your Epicurean Experience Package. Our insurer will reimburse you for the monies prepaid for your Epicurean Experience Package should we go insolvent.

5. Pricing

5.1 Where to find the price for Epicurean Experience Packages. The price of the Epicurean Experience Packages will be provided to you over the telephone by Epicurean Experience team when you contact them or as set out on our website. The price of Epicurean Experience Package is the price in force at the date and time of your order (as provided by our Epicurean Experience team), except where there is an inadvertent technical error. Any prices quoted on our website or otherwise provided in any applicable material from time to time are illustrative only, and we may change the price of the Epicurean Experience Packages before you place an order. All prices shown for Epicurean Experience Packages are inclusive of VAT and cover the price of both your stay at Epicurean Collection and the relevant third party service.

5.2 Payment method: We can take payment for the Epicurean Experience Packages by credit or debit card using the details provided when you contact our Epicurean Experience team.

5.3 What happens if we get the price wrong. We try to ensure that any prices for Epicurean Experience Packages provided to you over the phone are accurate but we may from time to time need to validate the price of your order as part of our acceptance procedure. We will inform you in writing if the price of the Epicurean Experience Packages is higher than stated when you placed your order and if this is the case you shall have the option to accept the order at the higher price or to cancel your order and receive a refund. We will not process your order until we have your instructions. If we are unable to contact you we will treat that order as cancelled and notify you in writing.

5.4 We can charge interest if you pay late. If any payment declines, we may charge interest to you on the overdue amount at the rate of 2% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount. You must pay us interest together with any overdue amount.

5.5 What to do if you think an invoice is wrong. If you think any payment is wrong please contact the Epicurean Experience team promptly in accordance with clause 2.2 to let us know and we will not charge you interest until we have resolved the issue.

6. Changes to the Epicurean Experience Packages

6.1 Your right to change your order. Once you have purchased an Epicurean Experience Package from us you will not be able to change your order. However, if you are unable to enjoy your Epicurean Experience Package you may be able to transfer your package to another person. See clause 6.2 below for more details.

6.2 Transferring your order to another person where you are unable to enjoy your Epicurean Experience Package. If you are unable to make use of your Epicurean Experience Package, you may be able to transfer your Epicurean Experience Package to a person who satisfies all the conditions applicable to the package. In order to do so, you must provide us with notice of your intention to transfer in good time before the date when your Epicurean Experience Package is due to begin using the contact details in clause 2.2, and we will confirm to you whether such transfer is possible. In such circumstances, you will not be entitled to a refund and will remain liable for the price of your Epicurean Experience Package, as well as any additional costs which may arise from such transfer.

6.3 Our right to make changes to these Terms and the Epicurean Experience Packages. From time to time, we may revise these Terms and/or the Epicurean Experience Packages we offer, for example:

(a) as a result of changes in relevant laws and regulatory requirements;

(b) to update the process you use to order such Epicurean Experience Packages, including how we accept payment from you; or

(c) to update our list of preferred third party suppliers who we arrange to provide the services you order.

6.4 What happens if we make changes to these Terms and/or the Epicurean Experience Packages after your order has been accepted. We will inform you in writing as soon as reasonably possible if we are required to make any changes to these Terms and/or the Epicurean Experience Package you have ordered after we have accepted your order. We will provide you with details of any required changes to your Epicurean Experience Package (including any change in price or substitutes we are able to offer you) and, where such changes negatively affect the supply of the relevant Epicurean Experience Package to you, you have the option to cancel your order and receive a refund if you do not wish to accept such changes.

6.5 Minimum numbers required for Epicurean Experience Packages. Certain Epicurean Experience Packages may require a minimum number of participants in order to take place. Where this is the case, we will inform you of the minimum number of participants required at the time you place your order, as well as the date by which we will notify you if the minimum number of participants have not signed up. Where the minimum number of participants do not sign up for your selected Epicurean Experience Package, we will notify you in accordance with clause 6.4.

7. Your Registration Details

7.1 You can amend your details at any time. To amend the details you provided to us, you will just need to contact us in accordance with clause 2.2. We always endeavour to make sure that the information we hold about you is up to date, and you can check that your details are up to date by contacting us in accordance with clause 2.2.

7.2 Use of your registration details. We will collect and process the personal identifiable information you provide to us on your registration form, this being your name, address, date of birth, email address and telephone number:

(a) to allow you to use all of the features of Epicurean Experience Packages;

(b) to arrange for the supply of the Epicurean Experience Packages to you and to record any such order you make;

(c) to process your payments/assist third parties completing transactions for the Epicurean Experience Packages;

(d) to update your records;

(e) to improve Epicurean Experience Packages, keep Epicurean Experience Packages safe and secure and ensure the content on Epicurean Experience Packages are presented in the most effective manner;

(f) to contact you in relation to the supply of, or problem with, any Epicurean Experience Packages ordered;

(g) to provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes; and

(h) to notify you about changes to your Epicurean Experience Packages or these Terms.

In collecting your personal information, we as data controller shall ensure that it complies with its obligations under the Data Protection Act 1998 (or any subsequent legislation). Please see our Privacy Policy for further details about how we collect your personal information.

7.3 Disclosing your details to third parties. We will only use your personal information for the purposes described in clause 7.2 above. In connection with these purposes, we may disclose your personal information to our third party suppliers and third party partners and to our professional advisors where:

(a) your order requires us to do so; and

(b) the law requires us to do so.

We ask anyone who receives your personal information from us to treat that information as confidential.

7.4 Your rights in relation to marketing. Any personal information you give to us will only be used by us and our group companies in connection with any Epicurean Experience Packages. We and our associated organisations may use your personal information to let you know about Epicurean Experience Packages that may be of interest if you agree for us to do so when you or order any Epicurean Experience Packages. Even if you agree to us providing you with marketing information, you can always opt out at a later date by contacting us in accordance with clause 2.2 or writing to us at enquiries@epicurean.club. We will not give your personal data to any other third party.

7.5 Other important terms. Please also review our Privacy Policy and our Epicurean Website Terms of Use, which set out more information about how we deal with and use your personal information and include important terms which may apply to you.

7.6 What happens to my order details after you have enjoyed Epicurean Experience Package (or cancelled in accordance with these Terms). Once all outstanding payments have been made, your payment details will be securely destroyed by our third party payment provider. We will retain your contact details and purchase history for as long as we are required by law or to deal with any possible disputes or as long as we reasonably require it for commercial reasons.

7.7 Your rights in relation to your personal information. You have the right to a copy of the personal information we hold about you and to have any inaccuracies corrected. We charge £10 for information requests. Please send requests to enquiries@epicurean.club

7.8 Complaints in relation to your personal information. 8. Cancelling your EPICUREAN Experience Packages

8.1 Please note that for Epicurean Experience Packages, you will not have a right to a refund in the case of cancellation once your order has been accepted save for as set out in clause 6.4 above. We may in exceptional circumstances, offer a refund to you, however this will be entirely at our discretion and we reserve the right to determine how much to refund you for your purchase of the Epicurean Experience Package in this instance.

8.2 Cancelling the Epicurean Experience Packages. To cancel your Epicurean Experience Package in accordance with these Terms, you can contact us directly using the contact details at clause 9.2.

9. If there is a COMPLAINT ABOUT THE Epicurean Experience Packages

9.1 How to tell us about complaints. We care about your experience and want to ensure we maintain the highest standards possible. If you are not happy with the service you have received from us, we would like the chance to put it right. If you have any complaints about Epicurean Experience Packages or any of our third party suppliers, our internal complaint handling procedures are in place to deal with your concerns when things go wrong. You can access a copy of our complaints handling policy by visiting our Complaints Handling Policy page on the website. There is no charge for raising a complaint.

9.3 Summary of your legal rights. We are under a legal duty to supply Epicurean Experience Packages in conformity with this contract. If you are a consumer, advice about your legal rights is available from your local Citizens' Advice Bureau. For detailed information, please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06. Nothing in these terms and conditions will affect these legal rights.

10. Our responsibility for loss or damage suffered by you

10.1 We will use reasonable endeavours to ensure that all prices, descriptions, images and other information published on our website from time to time or provided to you by telephone are accurate at the date of publication, but there may be circumstances in which errors or omissions may occur, including regarding the description of the products, the price, promotions, offers and the availability of the Epicurean Experience Packages. Consequently, we do not warrant the accuracy or completeness of any information provided by us and, to the maximum extent permitted by law, we provide you with Epicurean Experience Packages on the basis that we exclude all representations and disclaim all express and implied warranties, conditions and other terms of any kind which, but for these Terms might have effect in relation to the Epicurean Experience Packages. These Terms (and any document referred to within these Terms) constitute the entire agreement between you and us.

10.2 We will not be liable to you, whether in contract, tort or otherwise for any:

(a) indirect or consequential loss or damage;

(b) any economic loss, including loss of revenue, profit, business, data or anticipated savings; and/or

(c) loss of reputation or goodwill;

that may be suffered or claimed by you which arises in conjunction with the use, inability to use or the supply of the Epicurean Experience Packages. If we are liable to you for any reason, our liability will be limited to the amount paid by you for the Epicurean Experience Packages.

10.3 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or that is caused by our third party suppliers. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us when you ordered the Epicurean Experience Packages.

10.4 Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any liability to the extent that it cannot be excluded or limited under applicable law or regulation.

10.5 The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permitted by applicable law.

11. Other important terms

11.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

11.2 You need our consent to transfer your rights to someone else. You may not assign any rights and/or transfer, subcontract or delegate any obligations under these Terms unless you have our consent.

11.3 Nobody else has any rights under this contract. This contract is between you and us. These Terms do not confer any rights on any person or party pursuant to the Contracts (Rights of Third Parties) Act 1999.

11.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Epicurean Experience Packages, we can still require you to make the payment at a later date.

11.6 Which laws apply to this contract and where you may bring legal proceedings. These Terms and any dispute or claim arising out of or in connection with them or their subject matter, whether of a contractual or non-contractual nature shall be governed by and construed in accordance with the laws of England. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute regarding these Terms and any and all dealings between us and you.
